Terms of Service

The legal agreement governing your use of ProxyCrown's website, dashboard, and proxy infrastructure services.

These Terms of Service ("Agreement") constitute a legally binding contract between you ("Customer", "you") and ProxyCrown Ltd ("ProxyCrown", "we", "us"), a company registered in England and Wales. By creating an account, purchasing a subscription, adding a Pay-As-You-Go credit balance, or otherwise accessing or using any ProxyCrown product or service, you confirm that you have read, understood, and agree to be bound by this Agreement in full. If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not agree to these terms, do not use the service.

Eligibility

To use ProxyCrown you must be at least 18 years of age and legally capable of entering into binding contracts. The service is offered exclusively to businesses, developers, researchers, and professionals acting in a commercial or professional capacity. The service is not available to residents of jurisdictions subject to comprehensive trade sanctions administered by OFAC, HM Treasury, the EU, or the UN, including but not limited to Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine. By using the service you represent and warrant that you meet these eligibility requirements.

Account Registration

You must register for an account to access the service. You agree to provide accurate, current, and complete information during registration and to update it promptly if it changes. You are solely responsible for maintaining the confidentiality of your account credentials, including your API keys and dashboard password. You must notify us immediately at support@proxycrown.com if you suspect any unauthorised access to your account. ProxyCrown is not liable for losses arising from your failure to protect your credentials. Each account is for a single entity; sharing accounts across unaffiliated organisations is prohibited.

Service Description

ProxyCrown provides proxy network infrastructure services, including Residential Proxies, Datacenter Proxies, ISP Proxies, Static Residential Proxies, and Rotating Residential Proxies, delivered via a managed gateway network. The service enables customers to route outbound HTTP, HTTPS, and SOCKS5 traffic through ProxyCrown's IP pool to perform legitimate business operations including web data collection, quality assurance testing, ad verification, brand monitoring, and cybersecurity research. The service does not include provision of content hosted by third parties, and ProxyCrown is not responsible for the availability or accuracy of third-party websites accessed through the network.

Acceptable Use

You may use ProxyCrown only for lawful purposes that comply with all applicable laws and respect the rights of third parties. You agree to comply with our Acceptable Use Policy, which is incorporated into this Agreement by reference and available at proxycrown.com/aup. Prohibited activities include, without limitation: sending unsolicited commercial messages (spam); conducting phishing, credential stuffing, or account takeover attacks; distributing malware or ransomware; performing denial-of-service attacks; circumventing authentication controls without authorisation; accessing systems or data without the owner's consent; infringing intellectual property rights; operating illegal marketplaces; violating sanctions laws; and any other activity that violates applicable law or the restricted-business policies of our payment providers. We may suspend or terminate accounts that violate this section without prior notice.

Subscription Plans and Pay-As-You-Go

ProxyCrown offers two billing models. Subscription Plans are prepaid plans that grant a defined bandwidth allocation per billing cycle (monthly or annual). Subscription fees are charged in advance at the start of each billing period. Unused bandwidth does not roll over to the next period unless expressly stated in your plan description. Pay-As-You-Go (PAYG) credits are purchased in advance and consumed as you use the service. PAYG credits do not expire provided your account remains active; credits are forfeited upon account closure. Prices are displayed in USD exclusive of applicable taxes. ProxyCrown reserves the right to modify pricing with at least 30 days' notice to existing subscribers.

Billing and Payment

All payments are processed by our third-party payment providers, each a PCI DSS Level 1 certified payment service provider. By providing a payment method, you authorise ProxyCrown (via its payment provider) to charge all amounts due under this Agreement. Subscription fees are charged automatically at the start of each billing cycle. Pay-As-You-Go credits are charged at the time of purchase. All charges are final and non-refundable except as expressly provided in our Refund Policy. If a payment fails, we will notify you and may restrict service access until payment is resolved. You are responsible for any applicable sales tax, VAT, or similar taxes; ProxyCrown will collect and remit tax where required by law.

Automatic Renewal

Subscription plans renew automatically at the end of each billing cycle (monthly or annual, as selected at checkout) at the then-current subscription price, unless you cancel before the renewal date. You will receive an email reminder at least 7 days before an annual subscription renews. To cancel auto-renewal, log in to your dashboard, navigate to Billing, and select Cancel Subscription, or contact support@proxycrown.com before the renewal date. Cancellation stops the next charge but does not entitle you to a refund of fees already paid for the current billing period.

Cancellation and Termination

You may cancel your subscription at any time through the dashboard or by contacting support@proxycrown.com. Upon cancellation, you retain access to the service until the end of the current paid billing period, after which your account will be downgraded or closed. ProxyCrown may suspend your account immediately, without prior notice, if we determine in good faith that you have violated the Acceptable Use Policy, engaged in fraudulent activity, initiated an unjustified chargeback, or pose a risk to the security or integrity of the network. ProxyCrown may terminate this Agreement with 30 days' written notice for any reason. Upon termination, you must cease using the service and pay any outstanding amounts due.

Suspension of Service

We reserve the right to suspend access to the service, with or without prior notice, in the following circumstances: (a) non-payment of undisputed fees; (b) breach of the Acceptable Use Policy; (c) fraudulent activity or misrepresentation; (d) suspected compromise of account credentials that poses a risk to other customers; (e) legal or regulatory requirement. We will aim to restore service promptly upon resolution of the underlying issue. Suspension does not relieve you of payment obligations for fees accrued prior to suspension.

Service Availability and SLA

ProxyCrown targets 99.9% monthly uptime across its gateway network. Live system status is published at status.proxycrown.com. Where a specific SLA is agreed in an enterprise order form, service credits will be issued in accordance with that order form. No SLA is offered for Pay-As-You-Go accounts or entry-level subscription plans. Service credits are your sole remedy for downtime and do not entitle you to a monetary refund. ProxyCrown may perform scheduled maintenance with advance notice; scheduled maintenance windows do not count against uptime calculations.

Intellectual Property

ProxyCrown and its licensors own all right, title, and interest in and to the service, including the software, dashboard, API, documentation, trademarks, and trade secrets. Nothing in this Agreement transfers any intellectual property rights to you. You retain full ownership of your data and any content you submit to the service. You grant ProxyCrown a limited, non-exclusive, royalty-free licence to process your data solely as necessary to operate and improve the service, in accordance with our Privacy Policy.

Confidentiality

Each party ("Receiving Party") may receive confidential information of the other party ("Disclosing Party") in connection with this Agreement. The Receiving Party will: (a) protect that information with at least the same degree of care it uses for its own confidential information, but no less than reasonable care; (b) use it only to perform under this Agreement; and (c) not disclose it to third parties without the Disclosing Party's prior written consent, except to employees and contractors who need to know it and are bound by equivalent confidentiality obligations. Aggregated, anonymised usage metrics are not confidential. This section survives termination of this Agreement for a period of three years.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, EXCEPT AS EXPRESSLY SET FORTH IN AN ENTERPRISE ORDER FORM. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROXYCROWN DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. PROXYCROWN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (A) NEITHER PARTY WILL BE LIABLE TO THE OTHER FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THIS AGREEMENT, REGARDLESS OF THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; (B) PROXYCROWN'S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT WILL NOT EXCEED THE FEES PAID BY YOU TO PROXYCROWN IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. These limitations do not apply to either party's indemnification obligations, breaches of confidentiality, or willful misconduct.

Governing Law and Disputes

This Agreement is governed by the laws of England and Wales, without regard to conflict-of-law principles. Any dispute arising from or related to this Agreement that cannot be resolved informally within 30 days shall be submitted to the exclusive jurisdiction of the courts of London, England, except that either party may seek emergency injunctive relief in any court of competent jurisdiction. If you are a consumer resident in the European Union, mandatory consumer protection provisions of your country of residence may apply and cannot be excluded by this choice of law.

Modifications to These Terms

We may update these Terms of Service to reflect changes to our services, business practices, or applicable law. We will provide at least 30 days' advance notice of material changes by email and/or by a prominent notice in the dashboard. If you object to revised terms, your sole remedy is to cancel your subscription before the effective date. Continued use of the service after the effective date of any change constitutes your binding acceptance of the revised terms.
